Subject: FYI: Post-Tenure Work Group Update

1.  Meeting with GCSU Director of Legal Affairs:  Per your request at our recent committee meeting, I met with GCSU Counsel (Marc Cardinalli) on 1 Dec 2010.  In short, his response to the request to review language regarding the disposition of information for pre-tenure (final repository of all documentation is the candidate) and post-tenure (destroying the documentation of an unfavorable review in the presence of a subsequent favorable review) was "This is not a legal question, but rather a policy question."   In addition, he requested that we funnel such requests through the Provost in the future. 

2.  Work Group Update Requested by Provost Jordan:  Copied below is a recent email conversation that I had with Provost Jordan regarding our work group.  You can see that this email exchange was triggered by an email reminder she received from me regarding the FAPC meeting scheduled for 3 Dec 2010.  The update I provided her on behalf of the post-tenure review work group might be of interest to you.  Should you notice inaccuracies in my update, please let me know. 

3.  Next Meeting of the Work Group: Once Spring 2011 classes begin, I will circulate another Doodle poll to try and identify a mutually convenient time at which we can meet.

The work group membership and the DRAFTS that the committee is presently considering are available at

At the post-tenure review work group's most recent meeting, we continued to review the existing language in the GCSU Academic Affairs Handbook.  The main items under consideration have been clarity of language and the appeal process.  The work group has not formally endorsed any proposed modifications and naturally any such proposed modifications are subject to review by the 2010-2011 FAPC. 

At our  most recent work group meeting, I was asked to meet with the GCSU Director of Legal Affairs (University Counsel) and seek guidance on a couple of matters.  Attached are the details for that request.  In short, the University Counsel said that these queries were not questions of a legal nature.  He also indicated that it is more appropriate for the work group to consult with you (the Provost) and that if there are queries that emerge that may require a legal opinion from University Counsel then you (the Provost) would be the one to request his opinions. 

Under the work group drafts, the notes of the Martha Colvin questions and the Craig Turner 26 Oct 2010 Notes have not yet worked themselves into the draft - which is dated from August.  The 26 Oct 2010 notes shows a DRAFT calendar (still under consideration by the work group) that reflects the thinking on the modifications to the appeal that were proposed for further consideration at the most recent meeting.  The work group will next meet in January 2011.  There will be an update provided at the FAPC meeting tomorrow.
